RIGHT OF WITHDRAWAL
In order to exercise the right of withdrawal, written notification must be sent to the SELLER by registered mail, fax, or e-mail within 14 (fourteen) days, and the product must be unused in accordance with the provisions set forth under “Products for Which the Right of Withdrawal Cannot Be Exercised” in this Agreement. In the event this right is exercised:
a) The invoice of the product delivered to the BUYER or the person designated by the BUYER must be returned. (If the invoice of the product to be returned was issued to a legal entity, it must be sent together with a return invoice issued by that entity. Returns of orders invoiced to legal entities cannot be completed without a return invoice.)
b) The return form,
c) The products to be returned must be delivered complete, undamaged, and with their original box, packaging, and any standard accessories, if any,
d) The SELLER is obliged to refund the total amount and the documents that put the BUYER under obligation to the BUYER within a maximum of 10 days from the date the withdrawal notice reaches the SELLER, and to receive the returned goods within 20 days,
e) If a decrease in the value of the goods occurs or return becomes impossible due to the fault of the BUYER, the BUYER is obliged to compensate the SELLER for damages in proportion to the fault,
f) If, due to the exercise of the right of withdrawal, the order total falls below the campaign threshold set by the SELLER, the discount amount benefited from under the campaign shall be cancelled.
PRODUCTS FOR WHICH THE RIGHT OF WITHDRAWAL CANNOT BE EXERCISED
Products prepared in line with the BUYER’s request or clearly personal needs and not suitable for return; underwear bottoms, swimwear and bikini bottoms, cosmetics, single-use products, kitchen appliances and utensils, products that are perishable or likely to expire, products that are not suitable for return due to health and hygiene reasons if their packaging has been opened by the BUYER after delivery; products that, after delivery, are mixed with other items and cannot be separated by their nature; goods related to periodicals such as newspapers and magazines (except those provided under a subscription agreement); services performed instantly in electronic form or intangible goods delivered instantly to the consumer; and audio or video recordings, books, digital content, software programs, data recording and data storage devices, and computer consumables cannot be returned if their packaging has been opened by the BUYER, in accordance with the Regulation.
In addition, the right of withdrawal cannot be exercised for services whose performance has started with the consumer’s approval before the expiration of the withdrawal period, pursuant to the Regulation.
For cosmetics and personal care products, underwear, swimwear, books, reproducible software and programs, DVDs, VCDs, CDs, and cassette tapes, stationery consumables (toner, cartridges, ribbons, etc.), and kitchen appliances and utensils to be eligible for return, their packaging must be unopened, and the products must be unused, untested, and undamaged.
